Agreement to Terms

By accessing and using Fluxlix (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service apply to all users of the Service, including users who are contributors of content, information, and other materials or services on the Service.

License Grant

Fluxlix grants you a limited, non-exclusive, non-transferable license to use the Service for the purposes defined in your Service agreement. This license is conditioned upon:

  • Your compliance with all terms and conditions of this agreement
  • Your payment of all fees as agreed
  • Your use of the Service solely for authorized purposes
  • Your compliance with all applicable laws and regulations

Any other use is strictly prohibited and will result in the immediate termination of your license.

User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Complying with all applicable laws and regulations
  • Not using the Service for any illegal or unauthorized purpose
  • Not transmitting viruses, malware, or other harmful code
  • Not accessing or searching the Service by any means other than the publicly supported interfaces
  • Not attempting to reverse engineer, decompile, or discover the source code or algorithms of the Service

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLUXLIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR LOST BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FLUXLIX'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Governing Law

These Terms of Service and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Fluxlix is incorporated, without regard to its conflict of law principles.

Any legal action or proceeding arising under or related to these Terms of Service shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction, and you consent to the personal jurisdiction and venue of such courts.
